By accessing our website or participating in our auctions, you agree to these Terms. If you do not agree, please refrain from using our services.

Eligibility

  • You must be at least 18 years old and capable of entering into legally binding contracts to participate in our auctions or use our services.
  • By registering, you confirm that all information you provide is accurate and up-to-date.

Auction Registration

  • Registration is required to participate in our auctions. This includes providing your name, contact details, and payment information.
  • We reserve the right to approve, deny, or revoke registration at our sole discretion.
  • Registrants may be required to provide a valid government-issued ID and agree to a credit verification.

Bidding Process

  • All bids are final and binding. By placing a bid, you agree to purchase the item if you are the winning bidder.
  • Bids cannot be retracted unless specifically allowed by Charleston Auctions.
  • Charleston Auctions reserves the right to reject any bid, withdraw items, or reschedule auctions without prior notice.

Payment Terms

  • Winning bidders are required to pay in full within the specified timeframe as indicated in the auction listing or invoice.
  • Late payments may incur penalties, and non-payment may result in cancellation of the sale and suspension from future auctions.

Buyer’s Premium and Taxes

  • A buyer’s premium may be added to the final bid price. Details of the premium will be included in the auction terms.
  • Buyers are responsible for any applicable sales tax, VAT, duties, or other fees unless a valid tax exemption certificate is provided.

Item Descriptions and Inspection

  • All items are sold “as is,” “where is,” without warranties, express or implied, unless explicitly stated otherwise.
  • Descriptions, photos, and other information provided are for reference only. It is the buyer’s responsibility to inspect items prior to bidding.
  • Pre-auction inspection periods may be available. Contact us for details.

Third-Party Auction Platforms

  • Charleston Auctions may host auctions on third-party platforms, such as BidSpotter. By participating, you agree to their terms and conditions in addition to ours.
  • Charleston Auctions is not responsible for technical issues, platform outages, or errors on third-party sites.

Shipping and Removal

  • Buyers are responsible for the removal, transportation, and associated costs of purchased items unless otherwise specified.
  • Removal must be completed within the timeline provided. Items not removed may be deemed abandoned and resold without refund.
  • Shipping is not provided, but items can be packed for shipping if a buyer provides a shipping label. The fee for packing winning items will start at $10 per lot and will increase depending on the time and materials needed.

Limitation of Liability

  • Charleston Auctions is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our website, participation in auctions, or purchase of items.
  • We are not responsible for errors, interruptions, or technical issues affecting your ability to bid or access our services.

Prohibited Activities

By using our services, you agree not to:

  • Engage in fraudulent or deceptive bidding practices.
  • Tamper with auction processes or systems.
  • Use our website for unlawful purposes or activities that violate these Terms.

Termination of Services

We reserve the right to suspend or terminate access to our services for violations of these Terms, fraudulent activity, or at our sole discretion.

Intellectual Property

  • All content on our website, including text, images, logos, and trademarks, is the property of Charleston Auctions or its licensors.
  • You may not reproduce, distribute, or use any content without prior written consent.

We reserve the right to update or modify these Terms at any time without prior notice. The latest version will be posted on our website and take effect upon posting. Continued use of our services constitutes acceptance of the updated Terms.

 

Governing Law

These Terms are governed by the laws of the state of Indiana, without regard to conflict of law principles. Any disputes will be resolved in the courts of Allen County, IN.
